Data & Confidentiality
Effective: September 7, 2026
These terms explain how Customer Data ownership, confidentiality, organization visibility and third-party processing are handled.
1. Ownership of Customer Data
You and your organization retain ownership of Customer Data submitted to the Services. KUSTOM KO receives only the limited rights needed to operate, support, secure and improve the Services as described in the Terms and Privacy Policy.
2. Confidential treatment
We treat non-public Customer Data as confidential and do not intentionally disclose it to unrelated third parties except as necessary to provide the Services, follow your instructions, protect rights or security, complete a permitted business transaction, or comply with law.
3. Your confidentiality obligations
You are responsible for deciding what information may be uploaded. Before uploading third-party confidential information, export-controlled information, regulated data, trade secrets or personal information, ensure your organization has appropriate rights, approvals and safeguards.
4. Organization visibility
Organization administrators may manage members and may have access to organization-controlled projects or records depending on product permissions. Users should not assume content inside an organization workspace is private from authorized organization administrators.
5. Subprocessors
We may disclose limited data to infrastructure, authentication, payment, email and support providers that perform services for KUSTOM KO. Such access is limited to the service function and is subject to provider terms and applicable contractual safeguards.
6. Backups and exports
Cloud storage and backups reduce risk but do not replace your own records-management obligations. Maintain independent copies of business-critical source files, approvals and records where loss would materially affect your operations.
7. Legal requests and emergencies
We may preserve or disclose information when required by valid legal process or when we reasonably believe disclosure is necessary to protect rights, safety, security or the integrity of the Services, subject to applicable law.
8. Contact
Questions about confidentiality or data handling can be sent to contact@kustomko.com.
